vgb-b screening

Ongelezen bericht door nikil »

I am an indian citizen living in NL since 4 .5 years. Managed to get a new job in NL that needs a vgb-b clearence. But now my VGB-B screening process has been delayed by 4months.I have lived in India in the past since birth(studied there, worked there, before coming to NL) and also travelled to Saudi Arabia on a work visa(1.5 years in total) for work on behalf of an Indian company. No criminal records ever. what is the chance i will get a clearence within 4 months? Does the dutch security investigation have good relations with India and saudi arabia for information exchange? Experiences welcome with security screenings

A VGB differs from a VOG investigation because they are conducted by two different parties. One is conducted by the police and the other bij the Dutch intelligence agency. The latter had longer lead times so it takes longer to get a result. This is probably caused by the multitude of requests that come in annually.

For instance, when we have to have a investigation ourselves (police officers) when changing to a different, more secure job location, it can take over 6 months. For civilians it will be no different.

So there is no conclusive answer to give on this matter.

Officially it has to be done within 8 weeks. If it takes longer you will be notified of this. In your case information from abroad is required. During the period the information from abroad is gathered your application will be put on hold.
I believe they only look back to the last 8 years.

Not sure if it's helpful but I had to undergo a screening for a job change . This screening was (or still is ?) done by the Dutch intelligence agency (AIVD / MIVD)
In my case I did not need a VGB, but a PSC (Personnel Security Clearance) .
The AIVD website mentions that a PSC is only issued for people with the Dutch nationality, and for people from abroad different rules apply (procedures from the country of origin). In my opinion it would not make sense if there were huge differences in screening for a VGB or a PSC...

Since you have the Indian nationality it would not hurt if you contact the AIVD and ask them your questions directly and ask them for your chances.
Obviously things always take time, but if it means you cannot start this job for another few months I would try to speed up wherever I can.
In the end you will have to pay your bills meanwhile, right ? And if chances are low to get the VGB you better know now, so you can look for another job.

This is a court ruling on a similar subject. https://deeplink.rechtspraak.nl/uitspra ... 2021:17124

Maybe the person involved did not have a criminal record either, but this could simply not be proved since the person worked in Turkey for a number of years, and information exchange between Turkey and the Netherlands was lacking.
The judge argued the interests of national security outweighed the interests of this person in this case.

Yes thanks for your replies. I tried contact with avid but they do not given much information other than telling me that the investigation is still in "process".It is so difficult to make a decision in this scenario .

I think it is possible to file an official complaint with the AIVD of they fail to meet their own official deadlines. C.f https://www.aivd.nl/onderwerpen/klacht- ... er-de-aivd

Not respecting a deadline violates (Awb 4.13) especially if no new period has been set (Awb 4.14).

Although the complaint will not automatically grant you your security clearance (VGB), it will probably make the AIVD liable for a fine (c.f
https://www.rijksoverheid.nl/onderwerpe ... ar-te-laat). And if nothing else it will raise awareness of your request for security clearance (VGB) and probably will bump the priority in the work stack for the in depth research desk (het AIVD VGB diepteteam).

Do mind that I'm not a lawyer...
